Private Home Care Client Rights and Responsibilities
The client has the right to:
- access accurate and easy-to-understand information related to client services;
- be treated with respect and to maintain one’s dignity and individuality;
- voice grievances and complaints regarding treatment of care that is furnished or not furnished, without fear of retaliation, discrimination, coercion, or reprisal;
- a choice of approved service providers;
- accept or refuse services;
- be informed of and participate in preparing the care plan, and any changes in the plan;
- be advised in advance of the providers who will furnish care and the frequency and duration of visits ordered and the right to refuse that service;
- confidential treatment of all information, including information in the client record;
- receive services in accordance with the current care plan and, whenever possible, at the preferred dates and times;
- be informed of the name, business telephone number and business address of the person supervising the services and how to contact that person;
- have the client’s home and property treated with respect;
- be fully and promptly informed of any cost of services, including cost share liability and the consequences if any cost is not paid;
- review his/her records upon request;
- receive adequate and appropriate care and services without discrimination;
- be free from mental, verbal, sexual, and physical abuse, neglect, exploitation, isolation, corporal or unusual punishment, including interference with daily functions of living;
- be free from actual chemical or physical restraints;
- obtain a copy of the most recent licensure inspection; and
- be informed of the name, business telephone, and business address of the person supervising client services and how to contact that person.
The client has the responsibility to:
- notify service providers of any changes in care needs or condition that affects the client’s service, including medication changes, functional changes, and hospital admissions;
- treat provider staff in a courteous and respectful manner, as well as cooperate with and respect the rights of the caregivers providing care;
- be as accurate as possible when providing information on health history and personal care needs;
- actively participate in decisions regarding individual health care planning;
- comply with agreed-upon care plans;
- maintain a safe home environment or to inform provider(s) or the presence of any safety hazard in the home;
- be available to provider staff at times services are scheduled to be rendered; and
- pay for services ordered or any cost share liability, if applicable
